Thank you for choosing Big Red Creations for your graphic design and marketing needs. These Terms & Conditions outline the agreement between Big Red Creations and you, the client.

Services

I offer a variety of graphic design and marketing services. These services may include, but are not limited to:

• Logo design

• Branding materials

• Website design elements

• Marketing collateral

• Social media graphics

• Content creation (subject to additional agreements)

Project Fees & Payment Terms

I offer two pricing structures:

• Hourly Rate: My hourly rate will be agreed upon between you and Big Red Creations before project commencement.

• Fixed Rate: For specific projects, a fixed rate may be established and agreed upon before starting the project.

Payment Terms:

All invoices are due within 7 days of receipt. I accept payment via HNRY accounting. Bank transfers can be accepted if arranged prior to invoicing. Late payments may incur a late fee if prolonged more than the invoice date.

Project Revisions

A reasonable number of revisions are included within the agreed-upon project scope. Excessive revisions may incur additional charges based on the hourly rate or a pre-determined revision fee. I will always communicate any potential additional costs to you before proceeding.

Copyright & Ownership

I retain ownership of all original design concepts and files until full payment is received.

Upon full payment, copyright ownership of the final design files will be transferred to you, unless otherwise agreed upon in writing.

Working Files

I retain all working files (e.g., editable design files such as Adobe Illustrator, Photoshop, or InDesign files) unless explicitly agreed upon otherwise. These files are considered my intellectual property and are integral to my design process.

If you require the release of working files, this must be requested in writing. Please note that a premium fee will apply for the release of working files to cover the loss of my intellectual property and potential future work. The cost will be agreed upon on a case-by-case basis.

Confidentiality

I will maintain the confidentiality of all client information received during the course of the project and will not disclose it to third parties without your prior written consent, unless required by law. If required and provided by the client, I am able to sign a Non-Disclosure Agreement (NDA) or a separate confidentiality agreement before commencing the project.

Social Media & Promotional Use

I reserve the right to share updates about ongoing projects and showcase completed designs on my social media channels and website for promotional purposes. When doing so, I will always credit the company or individual involved in the project.

Project Cancellation & Termination

I reserve the right to cancel any project at any time, with written notice. In such an event, you will be responsible for any work completed up to the point of cancellation and any associated costs.

You may also terminate my services at any time, with written notice. In such an event, you will be responsible for any work completed up to the point of termination and any associated costs. A cancellation fee may apply depending on the stage of the project and work completed.

Client Responsibilities

To ensure the smooth progression of your project, I require timely provision of all necessary information, content, and feedback from your side. Delays in providing these may impact project timelines and could incur additional charges if significant re-scheduling is required.

Hours of Service

My standard hours of operation are Monday - Friday, 9:00 AM to 5:00 PM NZST. Urgent services outside these hours may be available at a higher rate, agreed upon in advance.

Changes to Terms & Conditions

I may update these Terms & Conditions from time to time. I will notify you of any significant changes by posting them on my website or by direct communication.
