These Terms and Conditions apply to all users of this website and all clients who book advertising services on the Whitianga Digital Billboard. By submitting an enquiry or booking advertising space, you agree to these terms.
1. Definitions
We, us, our refers to the operators of the Whitianga digital billboard and this website.
You, your refers to the advertiser or individual making an enquiry or booking.
Content refers to any artwork, images or messages you provide for display on the billboard.
2. General Use of This Website
You agree to provide accurate information when submitting enquiries or bookings. You must not use this website for harmful, illegal or disruptive purposes.
We may update or change the website at any time.
3. Advertising Bookings
All advertising bookings are subject to availability. We reserve the right to decline any booking at our discretion.
A booking is only confirmed when payment has been received and artwork has been approved.
4. Content Requirements
You are responsible for ensuring that:
All content you supply is accurate, legal and suitable for public display.
You have full rights and permission to use any images, artwork, logos or text submitted.
Content complies with New Zealand law and community standards.
Prohibited content includes:
Offensive, hateful, discriminatory or inappropriate material
Political messaging that breaches electoral laws
Defamatory or misleading claims
Copyrighted material you do not have permission to use
We reserve the right to refuse, edit or request changes to any content that does not meet these standards.
5. Artwork and Design
If you supply your own artwork, it must meet our specifications. Incorrect sizing or formatting may delay your start date.
If you request design services, we will create artwork based on the details you provide. You are responsible for reviewing and approving the final design.
6. Display Scheduling
Your advertisement will run for the period purchased. Display times rotate with other advertisers.
We make every reasonable effort to ensure consistent uptime, although temporary interruptions may occur due to maintenance, technical issues or weather related factors.
No compensation is provided for brief or unavoidable downtime.
7. Payments and Refunds
All payments must be made in full before your advertisement goes live.
Refunds will not be provided once the advertisement has begun running, except where required by law.
If you cancel prior to the start date, partial refunds may be granted at our discretion.
8. Changes to Bookings
If you need changes to artwork, duration or scheduling:
Minor edits may be free if time allows.
Significant changes may incur a fee.
Early termination or reduction of time is non refundable.
9. Council and Compliance
We operate the billboard in accordance with Thames Coromandel District Council rules and requirements.
If the council requires changes, restrictions or temporary shutdowns, we may adjust or pause advertising as needed. No refunds will be given for compliance related interruptions outside our control.
10. Limitation of Liability
We are not liable for:
Loss of profit, sales or potential business
Any indirect or consequential damages
Issues caused by downtime, technical faults or third party failures
Errors or inaccuracies in the content you supply
Our total liability for any claim will not exceed the amount paid for the advertising period in question.
11. Privacy
Any information you submit through this website is used only for the purpose of handling your enquiry or booking. We do not sell or share your information with third parties except as required by law.
12. Intellectual Property
All designs created by us remain our intellectual property unless otherwise agreed in writing.
You grant us permission to display your advertisement as part of our portfolio or promotional materials unless you request otherwise.
13. Updates to These Terms
We may update these Terms and Conditions at any time. The most current version will always be available on this website.
